Rights of objection

Please note the following reagrd of your right of objection: If we process your personal data for the purpose of direct marketing, you have the right to object to this data processing at any time without giving reasons. This also applies to profiling in so far as it is connected with direct advertising.

If you object to the processing for direct marketing purposes, we will no longer process your personal data for these purposes. The objection is free of charge and needs no particular form. We kindly ask you to preferably turn to: F24 Marketing.

In the event that we process your data to safeguard legitimate interests, you can object to such processing at any time for reasons arising from your particular situation; this also applies to profiling based on these provisions.

We will then no longer process your personal data unless we can prove compelling reasons worthy of protection for the processing that outweigh your interests, rights and freedoms or the processing serves to assert, exercise or defend legal claims.

The processing of your personal data complies with the provisions of the EU GDPR and all other applicable data protection regulations. Legal bases for data processing result in particular from Art. 6 EU GDPR. We use your data for business initiation, to fulfil contractual and legal obligations, to offer products and services and to strengthen the customer relationship, which may also include analyses for marketing purposes and direct advertising.

Your consent to data processing can also constitute a permission for data processing. Before giving your consent, we will inform you about the purpose of data processing and your right of revocation.

If the consent also refers to the processing of special categories of personal data, we will expressly point this out to you prior to your declaration of consent. Processing of special categories of personal data in accordance with Art. 9 of the EU GDPR only takes place if this is required by legal regulations and there is no reason to assume that your legitimate interest in the exclusion of processing prevails.

Transfer of data to third parties

We will only transfer your data to third parties within the framework of legal regulations or with appropriate consent. A transfer based on your consent can be made to the respective providers, particularly in connection with the use of cookies requiring consent. Within our company, we ensure that only those persons receive your data who need it to fulfil their contractual and legal obligations.

In many cases, service providers support our specialist departments in fulfilling their tasks. The necessary data protection agreements have been concluded with all service providers.

Transfer to third countries / Intention to transfer to third countries

Data will only be transferred to third countries (outside the European Union or the European Economic Area) if this is necessary for the execution of contractual obligation, is required by law or you have given us your consent.

We may transfer your data to service providers or to group companies outside the European Economic Area: Switzerland, USA. Compliance with data protection is ensured by an adequacy decision by the European Commission (Switzerland) or the conclusion of EU standard contractual clauses on data protection based on the model of the European Commission, where we have implemented additional warranties as to safeguard appropriate data privacy.

Data retention

We retain your data as long as it is needed for the respective processing purpose. Please note that numerous retention periods require that data must be stored longer. This applies in particular to commercial or tax storage obligations (e.g. Commercial or fiscal retention, etc.).

If there are no further retention obligations, the data will be routinely deleted once the purpose has been achieved. In addition, we may retain data if you have given us permission to do so or if legal disputes arise and we use evidence within statutory limitation periods of up to thirty years; the regular limitation period is three years.

Secure transmission of your data

In order to protect the data we are processing against accidental or intentional manipulation, loss, destruction or access by unauthorized persons, we have implemented appropriate technical and organizational security measures. The security levels are continuously checked in cooperation with security experts and adapted to new security standards. The data exchange from and to our website is always encrypted. We offer HTTPS as the transmission protocol for our website, in each case using the current encryption protocols. In addition, we offer our users content encryption for contact forms and applications. Only we can decrypt this data. It is also possible to use alternative communication channels (e.g. by surface mail).

Obligation to provide the data

Pardot Marketing Automation System (“Pardot MAS”)

(If you are interested in Pardot MAS and how it can support our administrator communication in FACT24, please see the section on this later in this privacy statement).

We use the Pardot Marketing Automation System (“Pardot MAS”), a special software for collecting and evaluating the use of a website by website visitors and for sending advertising-newsletters.

When visiting this website, the Pardot MAS captures your click path and creates an individual usage profile using a pseudonym. For this purpose, cookies are used, which allow recognition of your browser. The legal basis is your consent, Art. 6 I 1 a DS-GVO.

However, you can deactivate the creation of pseudonymised user profiles at any time by configuring your Internet browser so that cookies of the domain “pardot.com” are not accepted. LinkedIn Insight Tag

Our website uses „LinkedIn Insight Tag“, a cookies of the LinkedIn Ireland Unlimited Company. The use is based on your consent, Art. 6 I 1 a EU-GDPR. The tool places a cookie within your web-browser which uses to collecting the following data: Your IP-Address, device- and browser-settings and website events (e.g. sites visited). The data is encrypted and subject to anonymization within seven days. Within ninety days from its collection, the personal data is deleted. LinkedIn does not share personal data with F24, but moreover provides anonymized reports on how our website content has been browsed as well as reports concerning the target groups we reached or could reach with our content. Additionally, the Insight Tag enables us to perform a so called retargeting. Retargeting means that we receive information on whether our ads are of any impact on the users and of interest for the users. That, again, enables us to place targeted ads beyond our own website without identifying you personally as a user. If you are operating a LinkedIn-account yourself as a member to their network, you may define how LinkedIn makes use of your personal data for advertising purposes by respective settings in your profile. When you visit our website and use one of the social plugins included on the site, your browser will establish a direct connection to the social media network’s server. Contact form / Contact by e-mail (Art. 6 I 1 a, b a, b EU GDPR)

There is a contact form on our website which can be used for electronic contact. If you write us using the contact form, we will process the information you provide in the contact form to contact you and answer your questions and handle your requests. Here, the principle of data minimazation is observed, in that you only have to provide the data that we absolutely need to contact you. This is your e-mail address and the message field itself. In addition, your IP address is processed for technical reasons and for legal protection. All other data is voluntary information and can be entered optionally (e.g. for more individual answers to your questions).

If you contact us by e-mail, we will process the personal data provided in the e-mail solely for the purpose of processing your inquiry. If you do not use the offered forms to contact us, no further data will be collected.

Newsletter / F24 News (Art. 6 I 1 a EU GDPR)

You can subscribe to a free newsletter on our website (F24 News). The e-mail address and your name provided with the newsletter registration will be used for sending the personalised newsletter. The principle of data minimazation is observed here, as only the e-mail address (if applicable name for personalised newsletters) is marked as mandatory. For technical reasons and for legal protection, your IP address is also processed when ordering the newsletter. We use the double opt-in procedure for sending newsletters by e-mail. This means that you will only receive advertising by e-mail if you have expressly confirmed beforehand that we should activate the newsletter service. This is done by sending you a notification e-mail and asking you to confirm that you would like to receive our newsletter to this e-mail address by clicking on a link contained in this e-mail.

Of course, you can cancel your subscription at any time via the unsubscription option provided in the newsletter and thus revoke your consent. Furthermore, it is also possible to unsubscribe directly from the newsletter mailing at any time via our website.

Administration communication in FACT24

In the FACT24 Administrator Console, it is possible to subscribe to a newsletter (communication on maintenance work or technical innovations) specifically addressed to FACT24 administrators. For this e-mail-based communication with administrators on maintenance work or technical innovations (no advertising content) in FACT24, we use a special software for recording and evaluating interactions with our newsletters. Pardot is used in the concrete basic configuration to track the general opening rate of our administrator communication (i.e. what percentage of recipients opened the newsletter) by means of web beacons, i.e. small graphics embedded in the administrator messages. Based on this information, we can optimize the relevance of our messages and identify possible needs to open new communication channels. We have excluded personal data collection technically and also organizationally via internal instructions. Neither personal tracking nor profiling takes place. You can also configure your Internet browser so that cookies from the domain “pardot.com ” are not accepted. If you do not want to contribute to the described determination of a general opening rate, you can also unsubscribe from our administrator communication. Unless an administrator signs up for e-mail-based communication of maintenance work, technical faults and new features in FACT24, or unsubscribes at a later date, he has the option of finding out about selected processes via the FACT24 Help Portal and the product interface, which we use to disseminate information specifically for FACT24 administrators. Demo Request, Support Request, User Report & Whitepaper Download, Event form, Web seminar form

On our website we offer you the option to send us a demo request or a support request, to download our reports or whitepapers or to download web seminar documentations. The data entered for the respective action will be processed solely for the purpose of carrying out the respective action you initiated. In doing so, we take into account the principle of data minimization by solely requesting the data objectively required for the respective action. For technical reasons as well as for legal protection, your IP address will always be processed during the respective actions. In order to offer you online seminars, we may use the ON24 Virtual Communication Platform of ON24 (“On24″), a web conferencing service of ON 24 Inc, 50 Beale Street, 8th Floor, San Francisco, CA 94105, USA, and its affiliates. These partners, like ON24 Inc, may be located in third countries outside the EU or the European Economic Area. We have concluded the necessary data protection contracts with the service provider (EU standard contracts on data protection including appropriate guarantees)” . ON24 receives the personal data that you provide when registering for an online seminar via ON24 in order to create the technical conditions for the provision of the online seminar and your participation.

ON24’s services are used by us to register attendance at online seminars that we host, to conduct online seminars and also to send promotional messages to you. This is done on the basis of your consent, Art. 6 I 1 a DSGVO. Please note that you can only participate in our online seminars via ON24 if you provide the data required for registration and the data required for sending a personal access link (name, e-mail address, telephone number, company, industry, your job title). Our website uses Form Assembly, a tool from Form Assembly Inc., 885 S College Mall Road No. 399, Bloomington, Indiana, USA, a subsidiary of Salesforce, to carry out our F24 preparedness test, for which you can register at https://fact24.f24.com/en/product/incident-preparedness-test/. If you register there using the contact form, we can efficiently enter your data, which you provide when registering, into our CRM system Salesforce using form assembly and process it further within our company. Privacy policy for webinars with GoToWebinar

To offer online- webinars, F24 uses the GoToWebinar software solution of LogMeIn, Inc. 333 Summer Street, Boston, MA 02210 USA. LogMeIn, Inc. is the controller of this service and respective data processing. The privacy policy of LogMeIn can be found with their website. To complete the web seminar, we will submit your login or customer information to LogMeIn, Inc. Your data will be processed on the basis of your consent (Article 6 I 1 a GDPR). For the implementation of the web seminar an encrypted connection between you and the organizer of the web seminar will be established. The webinars are recorded regularly to be posted on the F24 websites for later viewing. Questions and answers given by the participants during the seminar will also be recorded and replayed when retrieving the web seminar later. During and after the web seminar, statistics are collected. If you participate in a web seminar, in addition to your credentials we will receive information about the duration of the course, interest in the web seminar, questions asked or answers given for the purpose of further customer care or to enhance the user experience.

Scheduling an appointment with the online software Calendly


On our website you have the option to schedule an appointment with one of our experts on our SaaS solutions.
Herefore, we provide you with a contact form in which you are directed to our appointment booking portal. Here, you will be entering an email address, a telephone number (to determine your geographic location by means of the country code – we need this to assign your request to the competent person in our organization), your country and a note on how we can be of assistance to you.
As an appointment booking portal, F24 uses the online appointment scheduling software Calendly from Calendly LLC, 3423 Piedmont Road NE, Atlanta, GA 30305-1754, United States.
When you click on the booking button, you will be connected to our account at Calendly. There you select your preferred date and enter a name, first name and an e-mail address for sending the appointment confirmation, which you will then receive from Calendly by e-mail.
The processing of your data is based on your consent, Art. 6 I 1 a DS-GVO. Your details will be processed by F24 for the purpose of processing your enquiry and answering any follow-up questions. The data remains stored until you request us to delete it, the purpose for storing the data no longer applies (this is regularly the case when the questions have been conclusively answered) or you revoke your consent to storage. Mandatory legal provisions such as statutory retention obligations remain unaffected.
Calendly processes data in the USA, among other places. There is no level of data protection present which would be comparable to the EU. Therefore, we have agreed on so-called standard contractual clauses with Calendly. With these, Calendly undertakes to guarantee a level of data protection that essentially corresponds to that in the EU. However, due to the legal situation in the USA, despite our efforts to ensure adequate data protection at Calendly and also with the standard contracts, US authorities still may be authorised to access your data at Calendly without you being entitled to (effective) legal remedies. If you want to be sure that such access is excluded in connection with Calendly, please contact us by other means, e.g. by telephone, where we will also be happy to provide you assistance on all questions regarding our services.

Competitions

You can take part in our competitions on our website. If you fill out a competition mask or provide data in accordance with the respective conditions of participation, we process the data you provide there to carry out the respective competition and, if necessary, for one of our sales employees to contact you (if you have consented to advertising).

In order to participate in the competition, it is required to provide personal data. The participant expressly agrees that the data transferred will be processed for the implementation of the competition. The participant can also agree that he may receive messages in connection with the company F24 AG to the e-mail address provided. This consent can be revoked at any time by the participant. You only have to provide the data objectively required to carry out the competition and to notify you of the winner. This is your name, your title, the name of the company you are employed with and your e-mail address and, if applicable, other information that can result from the applicable terms and conditions for participation.

The mandatory information is marked with an (*) in our competition mask. Other information is optional and can be provided voluntarily. Participation in the competition is not possible without the mandatory information. If you only provide the mandatory information, this will have no effect on your participation.

When you participate in the competition, you can also give us your consent to contact you using the contact details provided, including your e-mail address, to inform you about products and events from the F24 world (see also registration for F24 News). Even after the competition has terminated, your data can then be used for advertising purposes, as long as you do not object to this.

The processing of personal data is based on your consent Art. 6 I 1 a EU DS-GVO. With the exception of affiliated F24 companies, your data will not be transferred to third parties. In individual cases, we can transfer your data to commissioned service providers as part of order processing. Each transfer of data mentioned is based on the respectively required data protection agreement.

You are entitled to the rights of the data subject (see paragraph “Your rights as a data subject”). To revoke your consent to advertising with effect for the future or to exercise your rights as a data subject, you can contact us at any time, preferably through dataprotection@f24.com or via any other channel.

Advertising for existing customers (Art. 6 I 1 f EU GDPR)

F24 AG is interested in maintaining the customer relationship with you and sending you information and offers about our products / services (specifying advertising purposes). Therefore, we process your data in order to send you relevant information and offers by e-mail. If you do not wish us to do so, you can object at any time to the use of your personal data for the purpose of direct marketing; this also applies to profiling insofar as it is connected with direct marketing.

If you declare an objection, we will no longer process your data for this purpose. The objection can be made free of charge and free of form without giving reasons and should preferably be sent by e-mail to F24 Marketing or by post to F24 AG, Ridlerstrasse, 80339 Munich, Germany.
